RULE OF COURT 5.20 COMPLIANCE

Super Vision USA ensures all registry providers have completed the 24 hours of training, covering:

  • Child Abuse Reporting Laws

  • Domestic Violence Dynamics (Power and Control cycles)

  • Child Development Psychology

  • Sexual Abuse Recognition

PROTOCOL FOR MONITORED EXCHANGES

The "Zero-Contact" Rule: To prevent violence during transitions:

  1. The Staggered Timeline: The "Visiting Parent" arrives 15 minutes early and goes to a designated "Waiting Zone" tracked by the app. The "Custodial Parent" arrives at the scheduled time, completes the handover, and departs. The Visiting Parent must remain in the Waiting Zone for 15 minutes post-departure.

  2. App Verification: The handover is only marked "Complete" when the app detects the Custodial Parent's GPS signal has moved a minimum of 500 feet from the exchange site.

GRIEVANCES AND COMPLAINT PROCEDURE

Per California standards, every user has the right to file a grievance.

  • Level 1: Informal resolution with the Supervisor.

  • Level 2: Formal digital complaint filed through the Sup Vision app.

  • Level 3: Review by the Super Vision USA Board "Ethics Committee."

  • Level 4: Reporting to the local Court's Family Law Facilitator or Ombudsman.

Terms of Service

USER CONDUCT AND SUPER BOT INTEGRITY

The Sup Vision app uses an AI persona ("Super") to moderate communications.

  • Anti-Bypass Rule: Any attempt to use "coded language" or secondary devices to circumvent "Super's" moderation will result in a "Flagged Event" sent to the attorneys of record.

  • Anti-Harassment: Use of the app to circumvent "No-Contact" orders results in account termination and court reporting.

  • Respectful Communication: Verbal abuse toward the supervisor or "Super" is a breach of service and may lead to immediate termination of the visit.

BILLINGS, CANCELLATIONS AND THE JUSTICE FUND

  • Pre-Payment Requirement: All visitation fees must be paid 48 hours in advance using a credit card through the app’s secure payment gateway.

  • Cancellation Policy: Cancellations made within 24 hours are non-refundable to compensate the professional supervisor for their reserved time.

  • No-Refunds on Platform: Payments made for the platform digital services, mobile apps, and monthly subscriptions are non-refundable, regardless of circumstances.

  • PBC Justice Fund: A 1% "Public Benefit Fee" is included in all transactions to fund pro-bono supervision for indigent families.

LIMITATION OF LIABILITY

  • Super Vision USA is a platform and a Public Benefit Corporation. While we verify the credentials of providers in our Registry, the user acknowledges that supervisors are independent professionals.

  • Super Vision USA is not liable for the actions, omissions, or clinical judgments of independent supervisors.

Privacy Policy

INFORMATION WE COLLECT

  • Biometric & Audio Data: Encrypted audio recordings of visitation sessions for court evidence.

  • Precise Geolocation: Real-time GPS tracking during "Monitored Exchanges" to ensure "Stay Away" orders are maintained. Tracking is only active during scheduled exchanges to ensure compliance with Restraining Orders.

  • Case Records: Court orders, Case Numbers, Restraining Order (DVRO) details, and Protected Party addresses.

DATA "WALL OF SEPARATION"

As a Public Benefit Corporation, we implement a "Need-to-Know" data architecture:

  • The Data Shield: We handle the most sensitive data in the legal system.

  • The "Shielded" Address: The address of a protected party in a domestic violence case is never visible to the other parent or the supervisor unless explicitly authorized.

  • Zero-Knowledge Encryption: Audio recordings are encrypted using AES-256 before leaving the device. Super Vision USA staff cannot listen to these files without a logged "Request for Evidence" from the court or both legal parties.

THIRD PARTY DISCLOSURES AND LEGAL PROCESS

We do not sell data. Access to recordings and sensitive intake forms is restricted to the Court and authorized counsel. We only disclose information to:

  • The Court of Record: Upon subpoena or standing order.

  • Law Enforcement: In cases of immediate danger or suspected child abuse.

  • Child Protective Services (CPS): As required by Mandated Reporting laws.

Neutral Reporting Role

DEFINITION OF NEUTRALITY

Neutrality is the cornerstone of the Super Vision USA mission. Our providers do not function as mediators, attorneys, or therapists. Super Vision USA operates as a Neutral Third Party. Our providers do not advocate; they observe. We report objective, observable facts (verbatim quotes, arrival times, gestures) and do not provide clinical opinions or custody recommendations.

  • Non-Advocacy: We do not take positions on custody disputes. Our presence is strictly for the protection of the child’s physical and emotional safety.

  • The "Silent Observer" Protocol: Except to greet the parties or intervene for safety, the supervisor remains a silent observer to ensure the most natural interaction possible between parent and child.

  • The "Standard of Integrity": We report only observable facts. We do not provide clinical opinions or custody recommendations.

  • Mandated Reporting: Per California Penal Code §§ 11164-11174.3, we will immediately report any suspicion of child abuse to the relevant authorities.

SCOPE OF DOCUMENTATION

Our reporting is limited to objective, observable facts.

  • Inclusions: Verbatim statements (quotes), physical proximity, arrival/departure times, specific gestures, and adherence to "Super" bot prompts.

  • Exclusions: We do not report on "vibes," "intentions," or "hidden meanings." We do not offer opinions on the "bond" between parent and child unless a clinical evaluation is court-ordered.

MANDATORY INTERVENTION THRESHOLDS

Neutrality ends immediately upon the following triggers:

  1. Safety Threats: Any physical or verbal threat toward the child or the other parent.

  2. Parental Alienation: Attempting to influence the child's opinion of the other parent or the court.

  3. Whispering/Secretive Conduct: All communication must be audible to the monitor and the Sup Vision recording device.

  4. Passing Contraband: The exchange of letters, gifts, or photos not pre-approved by the court or the monitor.
